What is Zero FIR?

You will often hear about FIR in news, movies etc. This is the first notice of any crime committed, which is lodged in the police station by the victim or any other person. A complaint can be lodged in any form, either oral or written. It is the responsibility of the Officer in Charge of the police station to write or make a complaint to the complainant. After the complaint is lodged in the FIR register, a copy of the complaint should also be given to the complainant, which contains information about the crime committed. After that investigation or further action is taken on that crime.

Crimes are generally classified into two categories, which include Cognizable and Non-Cognizable offenses. In case of cognizable offense, the police register the complaint of the complainant in the FIR register. Whereas in case of an undetectable offense, it is recorded in the NCR (Non-Cognizable Report) register. In case of non-cognizable offenses, a person can complain directly to the first class judicial magistrate.

What is Zero FIR?

The FIR of an offense can be conducted in any other police station besides the police station related to the area where the crime occurs. A copy of the FIR written by this police station is sent to the police station related to the incident. Only such complaints are called zero FIRs. When the police register the FIR of a complainant, an FIR number is also recorded related to that FIR, but no FIR number is written in the complaint written anywhere other than the police station area related to the incident, that is why it is called zero FIR.

Provisions regarding non-writing of FIR :-

If a police station refuses to write the FIR of a complainant, then the complainant can directly make a complaint in writing to the concerned Superintendent of police (SP). Apart from this, if after filing an FIR, the complainant feels that the investigating officer is not cooperating in the investigation or is giving protection to the accused, then in such a situation the complainant has some options.

Under Section 172 of the Criminal Procedure Code (CrPC), a police officer investigating a case is required to keep a diary related to that case. Every action taken by that officer will be written in that diary from day to day. Therefore, the complainant can seek information from the concerned SP or DCP office about the progress made in the investigation by exercising the right to information. Apart from this, the complainant can also apply to the court for information about the progress made in the investigation of the case.
